As a legal project, the Creative Commons rocks.
However, the Open Source software they've released that I've used (the Creative Commons tagging software) would crash, suffered from half-visible menus, etc. Either the quality of their software has improved greatly in the past year, or people are voting based on the Creative Commons legal project rather than the software project(s).
They have released software?
And, yes, this answer was added as a testment to the open source nature of their copyright-related legal projects.
